Terms and Conditions for use of The92.co.ukBy using The92.co.uk and accepting these Terms of Use you are entering into a contract with British Sky Broadcasting Limited of Grant Way, Isleworth, Middlesex TW7 5QD that will govern your use of The92.co.uk.

1.1 When we capitalise words, we are referring to the following:
Sky: means British Sky Broadcasting Limited and/or any relevant members of the British Sky Broadcasting Group of companies Sky Content: means any content or material owned or licensed by Sky or its commercial partners but excluding your own contributions (you should assume that anything, other than your own contributions, on The92.co.uk is Sky Content) The 92: is the 92 website at http://www.The92.co.uk Terms of Use: includes our Terms and Conditions for use of The92.co.uk, "The 92" Usage Policy and any other reasonable requirement that we notify to you in accordance with paragraph 9 (Changes)1.2 When we say 'we', 'us' or 'our', we are referring to Sky (as defined above).
2.1 You may only use The92.co.uk for your own personal, non commercial purposes and must do so in accordance with any additional licence or usage provisions that are specified for any particular Sky Content.
2.2 You must not copy, reproduce, republish, download, post, broadcast, transmit or make Sky Content (including other users contributions) available to the public or authorise or assist any one else to do so.
2.3 You must use The92.co.uk in accordance with our reasonable requirements from time to time and, upon our request, you will need to provide any proof or your identity or age that we reasonably require.
2.4 You agree not to use or allow The92.co.uk to be used in a way that is unlawful, infringes anyone else's rights, or restricts their use of the service.
2.5 We may, for security, legal or other operational reasons (including breach of these Terms of Use), remove any material posted or uploaded to The92.co.uk.
3.1 We will use reasonable care and skill to keep The92.co.uk operational though you should appreciate that we may need to suspend the service for maintenance or other operating purposes.
3.2 You should not assume that The92.co.uk is error free or fit for any particular purpose and we may modify, suspend or withdraw the service on reasonable notice and without liability to you.
3.3 While we will use reasonable care and skill to ensure that our content on The92.co.uk is accurate at the time of inclusion, there may be errors, inaccuracies or omissions in that content and you should not rely upon it without our confirmation in writing as to its accuracy. In particular, we cannot guarantee the accuracy of anyone else's content and may not have reviewed any contributions posted by other users.

4.1 All content and/or services provided on The92.co.uk (including any text, images or videos) are provided without warranties (to the extent permitted by law) including, for example, any warranties as to accuracy, satisfactory quality, fitness for any particular purpose, non-infringement of third party rights, or incompatibility with any software, hardware or material on the device you are using to view that content. The content you view may also have been provided by third parties.
4.2 While we will endeavour to provide The92.co.uk with reasonable care and skill we will not be liable for any loss or damage caused by:
4.2.1 interruption or delay in the performance of The92.co.uk caused by matters outside our reasonable control;
4.2.2 errors, bugs or viruses present in or suffered from your use of The92.co.uk that are not directly caused by or attributable to us;
4.2.3 failure to follow our reasonable instructions or regulations for using The92.co.uk;
4.2.4 us, our employees and/or agents:
a) where there is no breach of a legal duty of care owed to you by us, any of our employees or agents;
b) where the loss or damage is not a reasonably forseeable result of any breach of a legal duty of care owed to you by us, any of our employees or agents; or
c) to the extent that the loss or damage is increased by a breach by you of our Terms of Use.
4.2.5 incompatibility with any software, hardware or material on the device you are using to access The92.co.uk;
4.2.6 any content supplied by third parties (including contributions of other users of The92.co.uk) or any product or service advertised, promoted, offered or sold by third parties for use in connection with The92.co.uk; or
4.2.7 any other matter outside our reasonable control.
4.3 You will be responsible for all claims, liabilities, damages, costs and expenses suffered or incurred by us and/or our commercial partners (as applicable) as a result of any substantial failure by you to act in accordance with these Terms of Use.
5.1 You own the copyright in your own contributions to The92.co.uk. Because of the nature of how we present your contributions on the "The92" it will not be possible to attribute these to you.
5.2 For operational reasons, it may not always be possible to publish your name alongside your contribution and, by submitting a contribution, you agree to waive the rights you would otherwise have to such accreditation, together with any other moral rights granted by the Copyright, Designs and Patents Act 1988 and, so far as is legally possible, any broadly equivalent rights you may have elsewhere in the world.
5.3 You agree, by submitting your contribution to The92.co.uk, to grant both British Sky Broadcasting Limited and other members of the British Sky Broadcasting Group (from time to time) an irrevocable, perpetual, royalty free, non exclusive, transferable or sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, make available to the public, broadcast and/or transmit your contributions universally by any media now known or later invented for the full term of any rights that may exist in your contribution together with any extensions. If you do not want to give us rights to use your contributions for all purposes, please do not make a contribution to The92.co.uk.
5.4 All copyright, trade marks, licences and all other intellectual property rights in The92.co.uk and any content on it (including third party content and/or contributions other than your own) remain either our property or that of any relevant third party. Save for a right to view Sky Content for your own personal, non commercial purposes, nothing in these Terms of Use constitutes a licence or right to use any trade mark, patent, design right or copyright owned by us or anyone else.
5.5 You agree that you will not, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, make available to the public, broadcast and/or transmit any content on The92.co.uk without our written permission or that of any relevant third party.
5.6 By submitting your contribution to The92.co.uk, you warrant that your contribution:
5.6.1 is your own original work and that you have the right to make it available to us for the purposes specified at paragraph 6.3 above; and
5.6.2 complies with "The 92" Usage Policy.
6.1 You will not receive any payment or commercial gain from any advertisements, marketing or promotional content on The92.co.uk.
6.2 If you respond to any advertisements, marketing or promotional or other content on The92.co.uk, you will likely be doing so under the separate terms and conditions that relate to the particular advertisement, marketing, promotional or other content. You should familiarise yourself with these (if any) and ensure that you are happy with the applicable terms and conditions before proceeding.
6.3 Some of the content, products and services you can access via The92.co.uk are provided by third parties and you may find links to other websites or resources. We do not accept responsibility for anyone else's content, products or services and we cannot guarantee the accuracy of these or that they are virus or error free. You should not presume that we have endorsed anyone else's content, products or services and we recommend that you check all e-mails, attachments and files before downloading them.
6.4 Unless we expressly state otherwise, your dealings with, and interest in, promotions, services or third parties accessible via The92.co.uk are solely between you and the person with who you are dealing. By using The92.co.uk, you agree that we will not be liable for any loss or damage you suffer as a result of your dealings with third parties.
7.1 We may not use contributions that are not submitted in accordance with your obligations under these Terms of Use (and/or any variations to those).
7.2 We may, for security, legal or other operational reasons, withdraw provision of The92.co.uk service on reasonable notice.
We may vary The92.co.uk, its content and presentation and these Terms of Use on reasonable notice for security, legal and other operational reasons.
9.1 We may choose to transfer, sub-contract or otherwise deal with our rights and obligations under this agreement for operational reasons.
9.2 You may not transfer your rights or obligations under these Terms of Use to anyone else, though interested third parties may use The92.co.uk in their own right.
9.3 Any term of this agreement that is found to be unfair or unenforceable will be treated as deleted and the remainder of the terms will continue to govern our each of our respective obligations going forward.
9.4 These Terms of Use are governed by English law and the relevant European Union court will have jurisdiction over any claim or other matter arising from your use of The92.co.uk. We also may bring proceedings against you for breach of our Terms of Use in another country (where, for example, a judgment of the relevant European Union court would not be recognised).

1 You must not seek to post or upload any material that:
a) is in breach of, or promotes the breach of anyone else's rights (including third party intellectual property rights);
b) is defamatory, offensive or libellous;
c) promotes racism, bigotry, hatred or harm of any kind against any group or individual or would subject any person to ridicule or cause other people to shun or avoid such an individual;
d) harasses or advocates the harassment of another person or persons;
e) promotes conduct that is abusive, threatening, obscene or distasteful;
f) has any fraudulent purpose or effect;
g) exploits people in a sexual, obscene or violent manner;
h) contains violence, or offensive subject matter or contains a link to an adult website;
i) solicits personal or identifying information from any person;
j) provides any telephone numbers, street addresses, last names, URLs, email addresses or other personal or contact information;
k) contains or promotes content that is false, misleading or deceptive;
l) involves the transmission of unsolicited bulk email or any other form of abusive electronic communication such as "junk mail," "chain letters," "mass mailing", "instant messaging", "spimming," or "spamming";
m) contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
n) constitutes, furthers or promotes any criminal activity, enterprise or illegal act or provides instructional information about illegal activities including (but not limited to) making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
o) involves any commercial activity such as sales, contests, competitions, prize draws or lotteries, advertising, or marketing;
p) contains sexually explicit or suggestive material;
q) promotes, condones or glamorises hooliganism or bullying;
r) condones or glamorises alcohol and drug abuse;
s) may cause harm and offence to children or presents some risk or element of risk to the welfare of children;
t) promotes political parties, terrorism, vandalism or religious vilification;
u) promotes or denotes cruelty to animals;
v) invades the personal privacy of individuals; or
w) refers to any arrest of an individual or any active court proceedings.
2 You agree not to carry out or be involved in any of the following activities:
a) any criminal or illegal activity, including (but not limited to) child abuse, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful electronic files or abusive electronic communications, hacking, the infringement of anyone else's rights (including intellectual property rights) or theft of trade secrets;
b) advertising to, or soliciting any other user of The92.co.uk to buy or sell any products or services through it. You may not transmit any chain letters or junk e-mail to other users of The92.co.uk. You may not use any information obtained from The92.co.uk in order to contact, advertise to, solicit, or sell to any other user. In order to protect other users from such advertising or solicitation, Sky may restrict the number of messages which you may post on The92.co.uk in any 24-hour period to a number which Sky deems appropriate (in its sole discretion);
c) covering or obscuring the banner advertisements on any website affiliated with Sky via HTML, CSS or any other means;
d) automated use of any website affiliated with Sky, such as using scripts to send comments or messages;
e) interfering with, disrupting, or creating an undue burden on The92.co.uk or the networks or services connected to The92.co.uk;
f) attempting to impersonate another person;
g) displaying an advertisement, or accepting payment or anything of value from a third person in exchange for you performing any commercial activity on or through The92.co.uk on behalf of that person, such as posting messages with any commercial purpose; or
h) using The92.co.uk in a manner that is inconsistent with any and all applicable laws.
3 You should report any material that breaches our Terms of Use to us and can do so by clicking on the "Report this" button for any contribution (where applicable). You can also alert us by e-mailing us at messages@The92.co.uk. We will consider all such notifications, though we reserve the right not to take action where we believe it is appropriate for the contribution to remain.
4 If you have breached "The 92" Usage Policy, or we reasonably suspect that you may have done so, we may, in addition to our other rights under these Terms of Use:
a) investigate the alleged breach of "The 92" Usage Policy, which may include gathering information from you and/or the complaining party (if any) and the examination of any other data or material on the Sky network or our servers;
b) notify and/or pass on the details of the breach of "The 92" Usage Policy to any relevant government, statutory, self-regulatory or law enforcement authority; and/or
c) remove (either temporarily or permanently), copy, store, monitor or otherwise deal with content, data and/or other material held on the Sky network and/or our servers.
5 By using The92.co.uk, you agree that we may use your personal and other account information in connection with any investigation we carry out in accordance with this usage policy, including by disclosing it to any third party authority that we consider to have a legitimate interest in that investigation or its outcome.
